Terms of Service

PMNM Simple is a social media scheduling app. You write a post once, attach a photo or video if you want one, choose the social platforms it should go to, and pick a date and time. At that time, PMNM Simple sends the post to the platforms you chose.

PMNM Simple works with platforms including TikTok and Facebook, and other social platforms we add over time. The list of available platforms can change as those platforms change their own rules and tools.

PMNM Simple is a tool for posting your own content on your own schedule. It does not write posts for you, it does not choose your audience, and it does not promise views, followers, sales, or any other result from a post.

To use PMNM Simple, you connect your own social media accounts and give us permission to post to them on your behalf. Those accounts stay yours.

• Your accounts are your responsibility. Keep your logins safe, and follow each platform’s own terms and rules. If a platform suspends or limits your account, that decision is the platform’s, not ours.
• Your content is your responsibility. The words, photos, videos, and links you put into PMNM Simple are yours. You are responsible for making sure you have the right to use them and that they are accurate and lawful.
• You keep ownership of your content. Using PMNM Simple does not give us ownership of anything you create. You only give us the permission we need to store your scheduled post and send it to the platforms you picked, at the time you picked.
• You must be old enough to enter into this agreement and to hold the social accounts you connect.

This is the core promise of the service:

• PMNM Simple posts only to the platforms you select for that post.
• PMNM Simple posts only the content you provide — your words, your photo or video, your links.
• PMNM Simple posts only at the time you schedule, or when you choose to post right away.

We do not post anything on your accounts that you did not create and schedule in PMNM Simple. If you disconnect a platform, we will stop posting to it.

Use PMNM Simple lawfully and honestly. You agree not to use the service to post or schedule content that is:

• Unlawful — breaking any law or regulation, or helping someone else break one;
• Misleading — false claims, scams, impersonating another person or business, or content meant to trick people;
• Infringing — using someone else’s photos, videos, music, writing, logos, or other work without their permission;
• Harmful, harassing, hateful, or threatening toward any person or group;
• Spam, or content that violates the rules of the platform it is posted to.

You also agree not to misuse the service itself — for example, trying to break into it, interfere with how it works, or use it through automated means we have not approved. If we believe a use breaks these terms, we may remove the scheduled content, pause posting, or close the account, and we will tell you why when we can.

You stay in control up until a post goes out. Any post you have scheduled can be edited or deleted before its scheduled time, and once you delete it, it will not be posted.

Once a post has been sent to a platform, it is live on that platform. PMNM Simple cannot pull it back for you — you can edit or delete it directly on that platform, under that platform’s rules.

Please check your scheduled posts, times, and time zone before they go out. A post scheduled for the wrong time is still a post you scheduled.

PMNM Simple uses TikTok’s Content Posting API. Until TikTok completes its audit of our app for direct posting, we use the draft (upload) option only. That means:

• Your scheduled TikTok video arrives in your TikTok account as a draft;
• Nothing goes public on TikTok from PMNM Simple during this period — you review the draft and you tap post;
• If TikTok approves direct posting after its audit, we will tell you before that changes, and these terms will be updated.

Posting to Facebook and other platforms works as described in Sections 1 and 3, subject to each platform’s own availability and rules.

PMNM Simple is offered by subscription. The subscription price is to be set, and the current price — along with what is included, the billing period, and any free trial terms — will be shown clearly before you subscribe.

• No charges without your agreement. We will not charge you until you have seen the price and agreed to subscribe.
• If the price changes later, we will give you notice before the new price applies to you, and you can cancel before it takes effect.
• You can cancel your subscription at any time. Cancellation stops future billing; it does not refund amounts already paid for a period that has already started, unless the law requires it or we tell you otherwise in writing.

PMNM Simple is provided “as is” and “as available,” without warranties of any kind, whether written or implied, to the fullest extent the law allows. That includes any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We work to keep the service running and to post on schedule, but we do not guarantee that the service will always be available, error-free, or on time. Social platforms can be down, can change their tools, or can reject a post — and those things are outside our control. A scheduled post that a platform refuses or delays is not a promise we broke.

To the fullest extent the law allows, Pay Me No Mind Consulting LLC will not be liable for indirect, incidental, special, consequential, or punitive damages — including lost profits, lost followers, lost sales, or lost data — arising from your use of PMNM Simple, even if we were told those damages were possible.

To the fullest extent the law allows, our total liability for any claim connected to the service is limited to the amount you paid us for PMNM Simple in the three months before the claim, or $100, whichever is greater.

Some places do not allow certain limits on liability. If that applies to you, these limits apply only as far as your local law permits. Nothing in these terms limits liability that cannot be limited by law.

We may update these terms from time to time — for example, when we add a platform, when a platform changes its rules, or when the law changes. When we make a change that matters, we will give you notice, by posting the updated terms with a new effective date and, where practical, by email or a notice in the service, before the change takes effect.

If you keep using PMNM Simple after an update takes effect, you agree to the updated terms. If you do not agree to an update, you can stop using the service and cancel before it takes effect.

You can stop using PMNM Simple and disconnect your accounts at any time. Posts already scheduled will not go out after you disconnect the platform they were scheduled for, so please review your queue before you disconnect.

We can suspend or end your access if you break these terms, if the law requires it, or if we stop offering the service. If we stop offering PMNM Simple, we will give you reasonable notice when we can. Sections that by their nature should survive — including ownership of your content, the “as is” section, and the limitation of liability — will survive after your use ends.

These terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules.
